German Federal Court of Justice (Bundesgerichtshof) allows appeal (Revision) by COREALCREDIT BANK AG against judgment in proceedings against former AHBR management board members

COREALCREDIT BANK AG had sued those past members of the former AHBR's
(Allgemeine HypothekenBank Rheinboden) Management Board who served between
2001 and mid-2002 for damages amounting to EUR 250 million in connection
with derivative transactions. The claim had been rejected at first and
second instance (see ad hoc notification dated 22 March 2011). The
Frankfurt/Main Higher Regional Court (Oberlandesgericht Frankfurt am Main)
in its judgment refused leave to further appeal; COREALCREDIT BANK AG
appealed this refusal with the so called 'Nichtzulassungsbeschwerde'
(appeal against refusal to leave to further appeal) before the German
Federal Court of Justice (Bundesgerichtshof).

Now, the German Federal Court of Justice accepted the
'Nichtzulassungsbeschwerde' and allowed the further appeal (Revision)
against the judgment of the Frankfurt/Main Higher Regional Court. The
outcome of the further appeal (Revision) remains to be seen. The further
appeal is pending with the German Federal Court of Justice under court
reference number II ZR 90/11.
