Planegg-Martinsried near Munich, July 19, 2012 - telegate AG's subsidiaries
datagate GmbH and telegate MEDIA AG finally win two compensation claims
against Deutsche Telekom AG for inflated pricing for the provision of
subscriber data in the last instance. The two claims account to receivables
in the amount of a total of approx. EUR 47 m as compensation of inflated
data cost - including interest payable as from commencement of the
proceedings. It has to be taken into account, that this sum will be reduced
by tax expenditure as well as success-related payments. The Federal High
Court of Justice (BGH) dismissed the appeal against non-admission of
Deutsche Telekom (case  no.: BGH KZR 31/11, BGH KZR 32/11). Thus, the
judgments delivered by the Higher Regional Court Duesseldorf on April 13,
2011 are final (case number OLG DD VI U 1/11, OLG DD VI U 6/11). The
company expects a signaling effect on the outstanding ruling brought by
telegate AG. In this case, the Higher Regional Court of Duesseldorf granted
EUR 41.3 m plus interest payable as from commencement of the proceedings to
telegate AG in June 2011.

telegate AG and its subsidiaries datagate GmbH as well as telegate MEDIA AG
brought an action against Deutsche Telekom AG for excessively invoiced data
costs in the years 1997 to 2004 in the total amount of EUR 86.7 m plus
interest payable as from commencement of the proceedings in three legal
proceedings. The Higher Regional Court Duesseldorf agreed in two actions
with telegate's subsidiaries datagate GmbH (reference number VI U 1/11) as
well as telegate MEDIA AG (reference number VI U 6/11) with the judgments
pronounced on April 13, 2011. The Higher Regional Court Duesseldorf also
made a largely positive decision on the third action of telegate AG
(reference number VI 2/11) on June 08, 2011. With dismissal of the appeal
against non-admission of Deutsche Telekom AG in the claim of datagate GmbH
as well as telegate MEDIA AG by the Federal High Court of Justice the
judgement of the Higher Regional Court Duesseldorf becomes final.
